Article 1 – Definitions
In this Disclaimer, the following terms shall have the meanings set out below:

Epic Motor Trading, trading name of Epic Trading Group, operator of the online auction platform
Platform
The website www.epicmotortrading.com and all related digital applications
User
Any natural or legal person who visits the Platform, registers or uses it
Buyer
The User who places a winning bid or whose bid is accepted
Seller
The natural or legal person who offers a vehicle through the Platform
Lot
The vehicle or item offered through the Platform
Bid
Any binding offer to purchase made through the Platform
Article 2 – General – No party to the purchase agreement
2.1. EMT acts solely as a technical and administrative intermediary platform between Buyer and Seller.
2.2. The purchase agreement is concluded solely between Buyer and Seller. EMT is not a party to this agreement.
2.3. EMT is not the owner of the offered vehicles, unless expressly stated otherwise.
2.4. EMT is not a seller within the meaning of Belgian consumer protection or distance selling legislation.
2.5. By using the Platform, the User agrees that EMT cannot be held liable in any way for the agreement between Buyer and Seller or for the performance thereof.
Article 3 – Limitation of liability for content of advertisements
3.1. EMT is not responsible for the accuracy, completeness, timeliness or reliability of the information that Sellers place in their advertisements.
3.2. The information in advertisements originates from the Seller itself. EMT does not carry out systematic checks on the accuracy of this information, except for the exceptions described in the General Terms and Conditions (such as HPI checks, which are performed without guarantee).
3.3. The following aspects of an advertisement fall outside EMT's responsibility, without this list being exhaustive:
- Year of manufacture, brand, model and version of the vehicle
- Mileage and technical condition
- Presence of original parts
- Damage history, restoration status or previous repairs
- Legal status (theft, damage history, outstanding finance)
- Presence and completeness of documents (registration certificate, service booklet)
- Any defects, visible or invisible
3.4. EMT is not liable for damages resulting from reliance on incorrect, incomplete or misleading information in advertisements. The Seller is at all times responsible for the accuracy of their advertisement.
3.5. EMT strongly advises Buyers to:
- Always physically inspect a vehicle before placing a bid
- Consult a CAR-PAS or similar history report
- Have an independent technical inspection carried out
- Check the identification numbers (VIN, frame number) against the documents
Article 4 – Limitation of liability for hidden defects
4.1. All vehicles are sold "as is, where is, with all faults" (in the condition they are in, at the location where they are, with all defects).
4.2. EMT gives no warranty, express or implied, regarding:
- The quality, safety or suitability of the offered vehicles
- The authenticity of parts or historical correctness
- The legal conformity of the vehicle (type approval, emission standards, etc.)
- The absence of hidden defects
4.3. Any claims relating to hidden defects must be directed exclusively to the Seller, not to EMT.
4.4. In disputes concerning hidden defects, EMT acts solely as a mediator at the request of the parties, but is not obliged to resolve a dispute and is not a party to the legal relationship between Buyer and Seller.
4.5. The statutory warranties that apply to sales by professional sellers (pursuant to Art. 1649bis et seq. of the Belgian Civil Code) remain fully applicable to the Seller. However, EMT is not a party to these warranties and cannot be held liable for their compliance.
Article 5 – Limitation of liability for VAT and tax aspects
5.1. EMT is not responsible for the correct VAT treatment of sales. The Seller is responsible for:
- Applying the correct VAT rate (0%, 21% or other EU rate)
- Remitting VAT to the competent tax authorities
- Complying with OSS obligations (One Stop Shop) for cross-border sales
- Correctly stating their VAT number on invoices
5.2. The Buyer is responsible for:
- Checking the VAT treatment on the invoice
- Possibly deducting input VAT in their own VAT return
- Complying with their tax obligations in their country of residence
5.3. EMT is not liable for fines, assessments or other tax consequences resulting from incorrect VAT treatment by the Seller or the Buyer.
5.4. EMT advises Users to consult a professional tax advisor if in doubt.
Article 6 – Limitation of liability for platform disruptions
6.1. EMT makes every effort to keep the Platform available 24/7. However, EMT cannot guarantee that the Platform will always be error-free, secure or uninterrupted.
6.2. EMT is not liable for damages resulting from:
- Temporary unavailability of the Platform due to scheduled maintenance, unforeseen failures or force majeure
- Technical errors in the software, including errors in the display of bids, timers or prices
- Loss of data due to unforeseen circumstances (hardware failure, cyber attacks, natural disasters)
- Delays in displaying bids due to network problems, slow internet connections or problems with external service providers
- Errors in integration with external services such as payment providers (Stripe) or verification services (Itsme)
6.3. EMT reserves the right to cancel, extend or suspend an auction if technical problems may affect the fairness or integrity of the auction. Such a decision is made to the best of its ability, but EMT is not liable for any damages resulting therefrom.
6.4. EMT advises Users not to delay critical bids until the last seconds of an auction, given possible technical delays.
Article 7 – Limitation of liability for bids
7.1. A bid is binding as soon as it is confirmed through the Platform. The Buyer cannot unilaterally withdraw a bid, unless expressly provided otherwise in the General Terms and Conditions.
7.2. EMT is not responsible for:
- Bids that are entered too high by mistake (e.g., €10,000 instead of €1,000). The Buyer is advised to carefully check their bid before confirming.
- Bids placed by unauthorized persons who have access to the Buyer's account (e.g., through theft of login credentials)
- Technical errors causing a bid not to be registered, confirmed or processed in time
7.3. The Buyer is responsible for:
- The security of their account (strong password, not sharing login credentials)
- Correctly entering bids
- Placing bids in a timely manner
7.4. EMT strongly advises Buyers to check the confirmation after each bid and to contact customer service if in doubt.
Article 8 – Limitation of liability for damages
8.1. Total liability
EMT's total liability, regardless of the legal basis (contractual, non-contractual, tort or otherwise), is limited to:
- The amount of commission received by EMT for the relevant transaction, with an absolute maximum of €5,000 (five thousand euros) , or
- If no commission was received: a maximum of €500 (five hundred euros) .
8.2. No indirect damages
EMT is never liable for indirect damages, consequential damages or business damages, including but not limited to:
- Loss of profit, revenue or income
- Loss of data or documents
- Reputational damage or loss of image
- Costs of replacement goods or services
- Loss of opportunities or potential transactions
- Damages resulting from business interruption
8.3. Damages caused by third parties
EMT is not liable for damages caused by:
- A Seller towards a Buyer (or vice versa)
- An external service provider (such as Stripe, hosting provider, or Itsme)
- A hacker or other malicious third party
- A fellow user of the Platform
8.4. Damages caused by the vehicle itself
EMT is not liable for damages caused by a vehicle sold through the Platform, including:
- Accidents or personal injury
- Material damage to property of the Buyer or third parties
- Environmental damage
- Fines or penalties resulting from the use of the vehicle
Article 9 – Indemnification by user
9.1. You indemnify EMT fully against all claims, damages, losses, fines, assessments, costs (including reasonable legal fees and collection costs) arising from:
- Your use of the Platform in violation of the General Terms and Conditions, the Vendor Agreement or this Disclaimer
- A dispute with another User (Buyer or Seller)
- An incorrect, incomplete or misleading advertisement by you (if you are a Seller)
- Incorrect VAT treatment by you (if you are a Seller)
- An infringement of third-party rights (such as property rights, trademark rights, copyright)
- A violation of applicable laws or regulations
9.2. This indemnification also applies to the directors, employees, representatives and contractors of EMT.
9.3. You are obliged to notify EMT immediately of a claim or threatened claim falling under this indemnification.
Article 10 – No financial or legal advice
10.1. EMT does not provide financial, tax, legal or other professional advice.
10.2. All information on the Platform, including but not limited to:
- Auction results and historical prices
- Information about VAT rates and tax obligations
- Information about statutory warranties and rights of Buyers and Sellers
- General information about classic motorcycles and their value
is purely informative and does not constitute tailored advice.
10.3. If you are in doubt about:
- The tax consequences of a transaction → consult a professional tax advisor
- The legal aspects of an agreement → consult a lawyer
- The technical condition of a vehicle → consult an independent expert or inspection body
- The financial consequences of investing in a classic motorcycle → consult a financial advisor
10.4. EMT is not liable for decisions made by Users based on information on the Platform.
Article 11 – Hyperlinks and external websites
11.1. The Platform may contain hyperlinks to external websites not operated by EMT.
11.2. EMT is not responsible for:
- The content, accuracy or completeness of external websites
- The privacy or cookie policies of external websites
- The security of external websites
- Damages resulting from the use of external websites
11.3. A hyperlink to an external website does not imply endorsement of the content of that website by EMT.
11.4. Users are advised to read the terms and privacy policies of external websites before using them.
Article 12 – Force majeure
12.1. EMT is not obliged to perform any obligation if it is prevented from doing so by circumstances beyond its reasonable control.
12.2. Force majeure includes, but is not limited to:
- Power outages, internet outages or telecommunications problems
- Cyber attacks, hacking, DDoS attacks or other security breaches
- Fire, flooding, explosion or other natural disasters
- Pandemics, epidemics or other health crises
- Strikes or lockouts at EMT or its service providers
- Government measures, legislation or court decisions
- Failures of external service providers (hosting provider, payment provider, verification services)
12.3. In the event of force majeure, EMT's obligation is suspended for the duration of the force majeure situation. If the force majeure situation continues for more than 30 days, EMT has the right to terminate the agreement with the User without being liable for compensation.
Article 13 – Applicable law and dispute resolution
13.1. This Disclaimer is governed by Belgian law, excluding the provisions of private international law.
13.2. Disputes arising from or relating to this Disclaimer shall be submitted to the courts of the district where EMT has its registered office (Antwerp).
13.3. Consumers additionally have the right to use the European ODR platform for online dispute resolution: https://ec.europa.eu/odr
13.4. Disputes shall first be submitted to the competent court. However, EMT and the User shall first attempt to resolve a dispute amicably before having recourse to the court.
Closing provision
This Disclaimer is an integral part of the General Terms and Conditions of Epic Motor Trading. By using the Platform, the User agrees to the provisions of this Disclaimer.
If any provision of this Disclaimer is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that approximates the intent of the original provision as closely as possible.

This Disclaimer is a separate document alongside the General Terms and Conditions, the Vendor Agreement, the Privacy Policy and the Cookie Policy. In the event of a conflict between this Disclaimer and the General Terms and Conditions, this Disclaimer shall prevail with respect to the limitation of liability.
